The users, subscribers, partners, and viewers (“Users”) accept the terms of these Guidelines by accessing and/or utilizing the services of POTOLO (the “Company”). The Users acknowledge that they agree to these Guidelines and accept the rights and obligations created by these Guidelines. These Guidelines are drafted to govern the conduct of the Users on the Company’s app. These Guidelines are designed to comply with applicable laws and standards.

1.1. Purpose of the Guidelines

The purpose of these Guidelines is to establish and communicate the foundational principles, policies, and standards that govern the interactions, behaviors, and practices of Users within the ecosystem of POTOLO's application-based services. These Guidelines are crafted to ensure that all Users, including but not limited to customers, partners, and service providers, engage in a manner that is respectful, responsible, and aligned with the values and expectations of the POTOLO community. They serve to promote a positive, inclusive, and safe environment where Users can access and offer a variety of services, such as food ordering, hiring for tasks or projects, health consultations, gym memberships, fleet management solutions, dry cleaning services, and the buying and selling of bus tickets, without the fear of encountering harmful, offensive, or inappropriate content. Furthermore, these Guidelines are designed to mitigate legal risks associated with defamation, intellectual property infringement, and other forms of inappropriate content, thereby protecting both the Users and the platform from potential liabilities.

1.2. Scope and Applicability

These Guidelines apply universally to all Users of the POTOLO platform, encompassing every feature, service, and interaction facilitated by the app. This includes, but is not limited to, the posting of reviews, ratings, and comments on services such as driver performance or meal quality, and any form of direct or indirect communication between Users. The provisions outlined herein are binding upon all Users, requiring adherence as a condition of access to and continued use of the POTOLO services. Compliance with these Guidelines is mandatory, irrespective of the User's role, the nature of the interaction, or the specific service being utilized. By accessing, browsing, or using the POTOLO platform, Users acknowledge their understanding of, and agreement to, these Guidelines and commit to conducting themselves in accordance with the principles and standards set forth. It is incumbent upon all Users to familiarize themselves with these Guidelines and to remain informed of any changes or updates that may be made periodically, as such changes or updates will also be binding.

2.2. Reviews and Ratings: Principles and Fairness

POTOLO recognizes the value of reviews and ratings as essential feedback mechanisms that facilitate trust and transparency within the community. Users are encouraged to provide honest, constructive, and factual feedback based on their experiences. Reviews and ratings should be free of bias, personal grievances, or misleading information. POTOLO is committed to maintaining the integrity of the feedback system and will take measures to investigate and address instances of abuse, manipulation, or fraudulent activity. Users found to be engaging in such activities may face consequences, including the removal of content, suspension of account privileges, or termination of account access.

2.3. Prohibited Content and Behaviors

The POTOLO platform is dedicated to providing a safe, inclusive, and respectful environment. As such, certain content and behaviors are strictly prohibited:

Hate Speech and Discrimination: POTOLO does not tolerate any form of hate speech, discrimination, or content that promotes hostility against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic. Such content will be promptly removed, and Users responsible for disseminating hate speech or engaging in discriminatory practices will face disciplinary measures, including account termination.
  • 2.3.2. Harassment and Bullying: The platform is a harassment-free zone. Bullying, intimidation, and harassment of any kind, whether through direct messages, public comments, or other means, are unacceptable. Users experiencing or witnessing harassment are urged to report the behavior to POTOLO for immediate investigation and action.

Users must refrain from spreading false information, engaging in deceptive practices, or making defamatory statements about others. Actions will be taken against Users who intentionally or negligently spread misinformation or engage in defamation.
  • 2.3.4. Spam and Commercial Solicitation: Unsolicited commercial messages, spam, and any form of phishing or fraudulent schemes are prohibited. Users must not use the platform for unauthorized advertising or solicitation, including the promotion of third-party products or services, without explicit permission.
2.4. Respect for Intellectual Property

POTOLO respects the intellectual property rights of others and expects its Users to do the same. Users must ensure that the content they share on the platform does not infringe upon the copyrights, trademarks, patents, or other intellectual property rights of third parties. Unauthorized use of copyrighted material, including but not limited to text, images, and software, without express permission from the rights holder, is strictly prohibited and may result in legal action in addition to platform-imposed penalties.

Users are expected to respect the privacy of others and refrain from accessing, using, or disclosing another User's personal information without their explicit consent. Violation of privacy and confidentiality standards may result in severe disciplinary action, including legal proceedings and termination of account access.

3. SPECIFIC GUIDELINES BY SERVICE
3.1. Food Ordering and Meal Quality Feedback

In the realm of food ordering and the provision of meal quality feedback, Users must adhere to the Guidelines that foster constructive criticism and genuine experiences. When providing feedback on food quality, delivery service, or kitchen partners, it is imperative that Users present their comments in a factual, respectful manner. Exaggeration, misrepresentation, or the dissemination of knowingly false information is strictly prohibited. Users are encouraged to detail their experiences with specificity, including aspects of service, meal presentation, and culinary quality, to assist others in making informed decisions. Furthermore, it is crucial that any criticisms are directed towards the service or meal quality, avoiding personal attacks or derogatory comments towards individuals. POTOLO is committed to ensuring that feedback mechanisms contribute positively to the quality of service offered by our kitchen partners and enhance the dining experience for all Users.

3.2. Hiring Workers for Tasks or Projects

The hiring of workers for tasks or projects through POTOLO must be conducted with professionalism, fairness, and adherence to applicable labor laws and standards. Users seeking to hire must provide clear, accurate descriptions of the work to be performed, including expectations, deadlines, and compensation details. It is prohibited to offer or accept tasks that are illegal, unsafe, or that violate the rights of workers in any way. Communication between Users regarding hiring should remain respectful, professional, and focused on the task at hand. Feedback on task completion should reflect the quality of work performed, adherence to agreed-upon parameters, and the overall work ethic displayed. Discrimination in hiring practices based on race, gender, age, religion, or any other protected characteristic is strictly forbidden and will result in immediate action by POTOLO.

Users utilizing health consultation services must engage with certified professionals in a manner that respects the boundaries and expertise of these individuals. Personal health information shared during consultations is protected under privacy laws, and POTOLO is committed to upholding the highest standards of confidentiality. Misrepresentation of qualifications, experience, or the efficacy of treatments is prohibited. When utilizing dry cleaning services, Users must provide feedback and lodge complaints in a manner that is constructive and respectful. Comments on service quality, timeliness, and customer service should accurately reflect the User’s experience, without resorting to hyperbole or unfounded accusations. Users experiencing issues with dry cleaning services are encouraged to resolve these directly with the service provider through the channels provided by POTOLO, where possible. POTOLO is committed to facilitating a resolution process that is fair and satisfactory for all parties involved.

3.7. Selling and Buying Bus Tickets – Honesty and Legality

The selling and buying of bus tickets through POTOLO must be conducted honestly, transparently, and in compliance with all applicable laws and regulations. Users engaged in these transactions are prohibited from scalping, price gouging, or engaging in any fraudulent or deceptive practices. It is essential that all information provided about ticket availability, pricing, and terms of use is accurate and truthful. POTOLO reserves the right to intervene in transactions that are deemed to violate these principles or the legal and ethical standards governing ticket sales and purchases. Adherence to these Guidelines is essential for maintaining the trust and safety of our community, and violations may result in disciplinary actions, including but not limited to, suspension of service access or termination of User accounts.

4.1. How to Report Inappropriate Content or Behavior: POTOLO is committed to maintaining a community that embodies respect, safety, and integrity. To this end, the platform provides a robust mechanism for Users to report any content or behavior that contravenes our Community Guidelines. Users can report inappropriate content, behavior, or any violations through the app’s dedicated reporting feature, accessible within the interface of each service offering. When submitting a report, Users are encouraged to provide a detailed account of the incident, including the specific nature of the violation, any relevant evidence (such as screenshots or descriptions of interactions), and the identity (User name or profile information) of the individual or entity involved, if known. This information is critical in enabling a thorough and expedited review process. POTOLO ensures the confidentiality of the reporting process, with the identity of the reporting User being protected to prevent retaliation or harassment.

4.2. Review Process for Reported Violations: Upon receipt of a report, POTOLO initiates a comprehensive review process. This process is designed to assess the validity of the reported violation accurately and impartially. A specialized team, trained in the evaluation of community standards violations, may conduct the review, considering the context, the nature of the reported content or behavior, and any pertinent User history. The review team may, at its discretion, engage with both the reporting party and the party reported against, to gather additional information or clarifications necessary for a thorough assessment. POTOLO endeavors to complete this review process promptly, with the goal of minimizing any potential harm or disruption within the community. However, the complexity and specifics of individual cases may lead to variations in the timeframe required to reach a resolution.

4.3. Consequences of Violating Community Guidelines: Violations of the Guidelines are met with appropriate and proportionate consequences, determined by the severity and nature of the violation, as well as any previous infractions by the offending User. Consequences may range from a warning or temporary suspension of certain privileges to permanent account termination in cases of severe or repeated violations. POTOLO reserves the right to remove any content deemed inappropriate, offensive, or harmful, without prior notice to the User who posted it. In instances where a violation may constitute illegal activity, POTOLO may, at its discretion, refer the matter to relevant law enforcement authorities. 4.4. Appeal Process for Enforcement Actions: POTOLO recognizes the importance of fairness and due process. As such, Users subject to enforcement actions, including content removal, suspension, or account termination, have the right to appeal such decisions. The appeal must be submitted through the designated appeals process, detailed within the User's notification of the enforcement action. Understanding 10DLC Requirements: The 10DLC (10-Digit Long Code) system represents a significant advancement in the management and regulation of Application-to-Person (A2P) text messaging in the United States (US), ensuring compliance with carrier policies and federal regulations. POTOLO's adherence to 10DLC requirements underscores our commitment to safeguarding the integrity of our communication channels and protecting the interests of our Users. This system facilitates enhanced delivery quality and reliability for business text messaging, while also implementing measures to prevent spam and unauthorized communications. By complying with 10DLC requirements, POTOLO ensures that all text-based communications sent to Users via our platform are transparent, authorized, and within the scope of regulated messaging practices. This framework is designed to respect User preferences and regulatory mandates, providing a secure and trusted environment for our community.

5.2. Opting In to Receive Text Messages and Communications

5.2.1. How to Opt-In: POTOLO provides Users with the ability to opt-in to receive text messages and other forms of communications regarding our services, updates, and promotional offers. To opt-in, Users can navigate to the communication preferences section within their account settings on the POTOLO app. Here, Users may find options to select the types of messages they wish to receive.
